NCUA Critic Named Trump Budget Chief

As reported by CU Times, President-elect Donald Trump has nominated a long-time critic of NCUA's spending and budget transparency as head of the Office of Management & Budget.
Congressman Mick Mulvaney (R-S.C.) will be responsible for the budget the President sends to Congress.  However, the OMB has budgetary authority over NCUA since the agency is not subject to the annual appropriations process.

Last month, Mulvaney sent a letter to NCUA applauding efforts to increase budget transparency but also raising concerns about agency spending. He also expressed displeasure with the NCUA paying attorneys $1 billion in legal fees in cases involving the sale of faulty mortgage-backed securities to five failed corporate credit unions. NCUA had hired attorneys on a contingency fee basis, a decision Mulvaney questioned.

In the U.S. House, Mulvaney is co-sponsor of legislation that would require any overhead transfer of agency expenses to the insurance fund to be legitimate, substantiated, insurance-related costs. Mulvaney also disagreement strongly with Debbie Matz when she was NCUA board chair.  In a July 2105 congressional hearing, Matz expressed her disbelief that credit unions represent their members. Mulvaney later referred to Matz's comments during a NAFCU congressional caucus saying that "To have oversight over an entire industry and think so poorly of the people in that industry was xhocking.”

The Financial Services-Information Sharing and Analysis Center (FS-ISAC) will conduct a free webinar
on 1/12, beginning at 1:00 p.m. The FS-ISAC is an industry forum for collaboration on cybersecurity threats, and recently created a credit union council at CUNA’s request.

The free webinar is designed to explore ways FS-ISAC can help credit unions get the latest information on how FS-ISAC can provide them with services and solutions to combat cybersecurity threats.

In November 2014, the Federal Financial Institutions Examination Council issued a statement recommending that “financial institutions of all sizes participate in the FS-ISAC as part of their process to identify, respond to, and mitigate cybersecurity threats and vulnerabilities.”  CUNA continues to work with the FS-ISAC, of which it is a member, to assist credit unions in monitoring and responding to cyberthreats, as well as sharing information that could be beneficial.

NCUA MBL Banker Challenge in Court Today

The U.S. District Court for the Eastern District of Virginia was scheduled to take up NCUA’s motion to dismiss the Independent Community Bankers of America’s (ICBA) lawsuit challenging the agency’s member business lending rule today.  CUNA and the National Association of Federal Credit Unions (NAFCU) jointly filed an amicus brief in the case.

The ICBA filed its suit in September. In their amicus brief, CUNA and NAFCU argue that the NCUA’s interpretation of the Federal Credit Union Act in the rule is well within the agency’s legal authority. The organizations also refute the ICBA’s assertion that the NCUA has, through rule-making, changed the definition of what is a member business loan.

State Charters Gain on Federals

According to a report by CU Jounal, state chartered credit unions in the United States now hold nearly 50% of all credit union assets. That's a 6.7% increase since the beginning of 2016, compared to 5.4% growth for federal credit unions.

There are over 2,300 state-chartered credit unions in existence, with assets totaling $631 billion. Memberships at state charters have hit 51.2 million (47% of total membership nationally, according to the National Association of State Credit Union Supervisors, a 3.2% rise from the end of 2015.

Return on assets, net worth ratios and loan-to-share ratios differences between state and federal charters are mostly non-existent, as are delinquency, net charge offs, net interest margins and membership growth.  Lending at state-charters, however, grew slightly faster at 8.2% as compared to 7.1% for federals.

According to CU Journal, a number of federally chartered CUs have converted to state charters in recent years.  Some CUs convert to charters in a belief that laws under the other charter are more nimble and allow them to serve their members.

Podcast: Elections Highlight Financial Anxiety

Americans feel financial anxiety insecurity about their future says Cathie Mahon in a podcast hosted by the Credit Union National Association.  Mahon is president/CEO of the National Federation of Community Development Credit Unions.

Mahon claims that Americans are demanding “somebody’s got to do something.  Regardless of political perspective, race, ethnicity, or geography, it's clear the American people are feeling financial anxiety. They're feeling a lack of financial security. They're feeling overburdened, stressed, fearful of their future."

In a wide-ranging conversation, Mahon shares her thoughts on 2016 and the year ahead, the Juntos Avanzamos initative, her background in public service, and the challenges community development credit unions face today.

The Federation serves community development credit unions, which specialize in serving people with limited access to affordable financial services, including low-income wage earners, immigrants, and minorities communities.

Co-op Economy Proposed in Paper to Trump

In a presidential transition paper sent to President-Elect Donald Trump today, the National Cooperative Business Administration outlined the many ways that cooperatives, including credit unions, can help answer some of the nation’s most critical challenges.

Called “Cooperating for a Better Tomorrow: Creating Economic Opportunity for Americans and People Around the World,” the transition paper unpacks the scope of influence of the cooperatives in the U.S. and asks the incoming Administration to consider the cooperative business model as a bi-partisan approach to federal policy making.

Encouraging close collaboration with the Congressional Cooperative Business Caucus and the Inter-Agency Working Group on Cooperative Development, the paper outlines key areas where the Administration could support cooperatives:
  • tax reform
  • worker ownership
  • the USDA Rural Cooperative Development Grant (RCDG) program
  • small business lending
  • inclusion of co-ops in the 2017 Economic Census
  • healthy and sustainable food access and the Global Food Security Act. 
“Cooperating for a Better Tomorrow reflects the value and power the cooperative business model has across many sectors of the American economy,” NCBA CLUSA president and CEO Judy Ziewacz said in a letter accompanying the transition paper.

Bankers Sue NCUA Again

As reported by Credit Union Journal and Credit Union Times, the American Bankers Association today filed a lawsuit against the National Credit Union Administration saying the regulator's new field of membership (FOM) rules go too far.  The case was filed in the DC United States District Court.

In its filing, the ABA says that NCUA's field of membership rule "disregards Congress' explicit instruction that community credit unions serve only a single, well-defined local community. Instead, it declares that large regions including millions of residents and cutting across multiple states are single 'local' communities."  The ABA also says the rule is part of a continuing effort by NCUA to expand the size and scope of credit unions.

ABA President/CEO Rob Nichols said in a statement . . .
NCUA's rule ignores statutory requirements at the expense of taxpayers, small banks and the communities those banks serve.  ABA has successfully sued NCUA three times on past occasions in which the agency exceeded its congressional authority, and we look forward to challenging their latest violation of the law in federal court.  The final rule risks further increasing the industry's tax exemption, which is already worth more than $27 billion over the next ten years.  Congress set appropriate limits on credit union activities in return for a tax-exempt status that no other trillion-dollar industry enjoys.
Many provisions in NCUA's initial proposed rule made it into the final rule, except for including a congressional district as a well-defined local community.  NCUA received 11,380 comments, about 3/4 of which were favorable. Recently, the Independent Community Bankers Association (ICBA) also filed suit againt NCUA over changes to its member business lending rule.

VSECU Board Vice-Chair Andrew Stickney, shared his thoughts on strategies and tips for incorporating more young innovative board members in credit union governance.  As the millennial generation grows in importance in the workforce and the overall economy, more credit unions are working to add millennial leaders to their boards.  Stickney joined Tara Leer, a board member of Idaho-based P1 FCU, in a CUNA podcast on the subject.

Stickney is CEO of Burlington Bytes, a full-service web design, build, and digital marketing agency in Burlington, Vermont. He formerly served as the vice president of the Vermont Center for Emerging Technologies, a business incubator and seed venture fund in Burlington.  Leer is a stay-at-home mom of three and a former marketing professional who was heavily involved in the community before joining the P1 FCU board.

NCUA Releases MBL Exam Guidance

Last week, in Letter to Credit Unions 16-CU-11, NCUA published examination guidance on its new member business lending (MBL) regulation that goes into effect in January.

NCUA chairman Rick Metsger stated that the guidance "will help credit unions understand NCUA’s supervisory expectations for sound commercial risk-management practices."

The guidance has been incorporated into NCUA's new online Examiner’s Guide, released in October. The online resource is interactive and provides examiners up-to-date supervisory guidance on key supervisory and regulatory issues.  The format provides easy navigation of topics of interest, keyword content search and easier connection to resources provided by NCUA and other regulatory agencies.

Vermont state-chartered credit unions are also subject to NCUA's member business lending regulation.  Recently, Vermont DFR Regulation B-2012-01 was repealed in favor of requiring compliance with NCUA's member business lending regulation (12 CFR Part 723).  However, a Vermont state chartered credit union wishing to embark in member business lending must still obtain the Department’s written approval before engaging in the business of making such loans.

NCUA FOM Comment Due This Week

In October of 2016 the NCUA board proposed a broadening of its field of membership regulation. The proposal increases the current 2.5 million population limit for communities consisting of a Core Based Statistical Area (CBSA) or Combined Statistical Area (CSA), subject to a credit union’s ability and commitment to adequately serve the area, to 10 million.

NCUA says the higher cap better anticipates and accommodates “inevitable growth” to the extent permissible by law.  The proposal would also allow a credit union to submit a narrative to establish common interests or interaction among residents of the area proposed to be served. This would qualify as a well-defined local community.

Black Friday Online Sales Hit $3B, Mobile Surpasses $1B

Last week's Black Friday online sales hit another record-breaking day. According to Adobe, which has been tracking e-commerce transactions throughout the sales holiday, Black Friday set a new record by surpassing the $3 billion mark. This was the first day in U.S. retail history to drive more than a billion dollars from mobile sales. This year's top-selling electronics were Apple iPads, Samsung 4K TVs, the Apple Macbook Air, LG TVs, and Microsoft Xbox.

Major retailers, such as Amazon, Wal-Mart, Target, and eBay, noted that mobile traffic and sales were on the rise. Amazon said that mobile orders on Thanksgiving topped Cyber Monday for 2015, while Wal-Mart said that more than 70 percent of website traffic on Thanksgiving was mobile. Target reported that 60 percent of Thanksgiving sales were from mobile devices.

Mobile was also driving the majority of retail sites visits on Friday at 56 percent, Adobe noted. The majority of sales (47 percent) were from smartphones, as opposed to tablets (nine percent).

Despite the record numbers, the e-commerce industry is still recovering from the downturn it took following the election.

CU Hostages Released / Robbery Statistics

As reported by various new outlets today, 11 hostages held at gunpoint were freed from a robbery attempt this morning at Community First CU in Jacksonville, FL.

The Jacksonville sheriff's office said that the hostages were held as part of the robbery for about two hours. A 911 call reporting a bank robbery came in at 9:06 a.m. this morning. A short time later, another call indicated that someone may have been shot, but the sheriff's office later reported that claim as being false.  SWAT team members and police negotiators were called in.  Two people hiding inside the bank, unknown to the hostage taker, tried to run from bank, thereby distracting the hostage taker and providing the SWAT team the opportunity to storm the credit union, placing themselves between the hostage taker and the hostages.  The suspect then surrendered.

Police aren't sure why the suspect took hostages at the credit union but say he made several requests over the course of the incident, including asking family members to arrive on scene.

The 911 call was made by a member in the credit union's drive-thru seeing several tellers walking through the building with their hands up. The credit union hostage situation included 12 members and 44 CU employees.

FBI Bank Robbery Statistics:

  • According to the FBI, in 2015 there was 56 separate hostage situations in United States financial institutions.
     
  • In terms of fatalities, 9 people in financial institution hostage situations were killed in 2015.  In 8 of the cases, the perpetrator died. In one instance a bank customer was killed.
  • During the 56 hostage situations, 10 customers, 35 employees and 9 bank robbers were injured.
  • In all in 2015, there were 4,091 bank robberies, with violence related to only 3% of them.
  • The most common day for bank robberies is Friday, followed by Wednesday and then Thursday. The most common time for bank robberies is right at opening. Last year 1,042 robberies occurred between 9 a.m. and 11 a.m. and 933 robberies occurred between 11 a.m. and 1 p.m.
  • In most cases a demand note is used, followed by cases where robbers demanded money and threatened others with weapons.
  • According to statistics, an explosive device was threatened in 108 different cases.
